Terms and Conditions (AGB)

1. Scope of Application
These General Terms and Conditions (AGB) apply to all contracts between Michael Puchalla (hereinafter "Coach") and the Client regarding the provision of coaching services.

2. Conclusion of the Contract
A contract is concluded when the Client accepts the Coach's offer. Acceptance can be made orally, in writing, or electronically (e.g., by email).

3. Coaching Relationship
Coaching is an ongoing cooperative and professional relationship that supports the Client in achieving the agreed-upon goals. The coach-client relationship is based on mutual respect and trust to create a safe and judgment free space for exploring potentially complex and sensitive topics. The Client understands that coaching may sometimes be challenging or uncomfortable.

Coaching is not therapeutic. The Client is solely responsible for their own physical, mental, and emotional well-being during and after the coaching process. Coaching does not substitute for psychotherapy, counseling, or therapy, nor is the Coach qualified to provide legal or financial advice.

4. Client's Duty to Cooperate
Coaching requires an active role from the Client. The Client agrees to engage with the process openly, take personal responsibility for their actions, and apply insights from the sessions in their everyday life. The success of coaching depends heavily on the Client's active participation.

5. Appointments and Cancellations
Appointments are binding. Cancellations or rescheduling must be made at least 24 hours in advance. Appointments canceled after this period or missed without notice will be charged in full.

6. Fees and Payment Terms
The applicable fees for the coaching services are stated on the website or individually agreed with the Client. The fee is due without deduction after the invoice is issued and must be paid within 10 days. In the event of default in payment, the Coach reserves the right to withhold further services.

7. Confidentiality
The Coach is committed to confidentiality regarding all information obtained during the coaching relationship. All discussions, whether verbal or written, are confidential and will not be shared with any third party unless there is evidence of harm to the Client, others, or an organization, or unless otherwise required by law.

8. Intellectual Property
All content, materials, and resources provided by the Coach during the coaching sessions, whether in the form of documents, presentations, videos, or other formats, remain the intellectual property of the Coach. The Client is granted a limited, non-exclusive, and non-transferable right to use these materials for personal, non-commercial purposes only.

The Client is not permitted to reproduce, distribute, modify, or share any coaching materials without prior written consent from the Coach. Any violation of these terms may result in legal action.

9. Liability
The Coach is only liable for intentional or grossly negligent behavior. The Coach is not liable for damages resulting from the use of the coaching services. The Client acknowledges that coaching is not a substitute for therapy or other professional services. The Client takes full responsibility for their own decisions and actions during and after coaching.

10. Data Protection
The Coach processes personal data of the Client exclusively for the purpose of fulfilling the contract and in accordance with applicable data protection laws. For more information, please refer to the privacy policy available on the website.

11. Insurance Coverage
The Client is solely responsible for ensuring their own insurance coverage, including health, accident, and liability insurance. Michael Puchalla does not provide or guarantee any insurance coverage for the Client in connection with the coaching services.

12. Final Provisions
Amendments and additions to these Terms and Conditions must be in writing. Should individual provisions of these AGB be invalid, the validity of the remaining provisions remains unaffected. Swiss law applies.

The place of jurisdiction is Zurich.
